SmileMatch | Dental students and patients

1. Agreement

By accessing or using SmileMatch ("Platform," "we," "us"), you agree to these Terms of Service. If you do not agree, do not use the Platform.

2. Platform role

SmileMatch provides technology that may help connect patients with dental students and participating educational programs. SmileMatch is a matchmaking and communication platform only. SmileMatch is not a dental practice, clinic, hospital, insurer, or healthcare provider and does not provide dental or medical care.

3. No medical responsibility

SmileMatch does not provide, supervise, direct, or guarantee any dental treatment, diagnosis, or clinical decision. All clinical care is provided by licensed professionals, students under appropriate supervision, and/or participating institutions under their own policies—not by SmileMatch.

4. User acknowledgments

You understand that treatment outcomes depend on many factors outside the Platform. You accept that care you receive through a matched connection is governed by the policies, rules, and supervision requirements of the relevant dental school or clinic. You are responsible for your own decisions to seek or decline care.

5. Eligibility and accounts

You must provide accurate registration information and keep your account secure. You may not misuse the Platform, impersonate others, or attempt to access data or accounts you are not authorized to use. We may suspend or terminate accounts that violate these Terms or create risk to users or the Platform.

6. User conduct

You agree not to harass, threaten, spam, or upload unlawful content. You agree not to reverse engineer the Platform or circumvent security or access controls. We may remove content or restrict features where necessary to protect users or comply with law.

7. Limitation of liability

To the maximum extent permitted by applicable law, SmileMatch and its affiliates, directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Platform or any care obtained through a match. The Platform is provided "as is" and "as available" without warranties of any kind, except where prohibited by law.

8. Indemnification

You agree to defend and indemnify SmileMatch against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Platform, your violation of these Terms, or your violation of others' rights, to the extent permitted by law.

9. Dispute resolution

If a dispute arises, you and SmileMatch agree to first attempt to resolve it informally. If informal resolution fails, disputes will be resolved by binding arbitration on an individual basis, and you waive any right to participate in class actions or class-wide arbitration, except where prohibited by law. The seat and rules of arbitration and governing law will be determined in a manner consistent with applicable regulations and will be finalized in a production-ready legal review.

10. Changes

We may update these Terms from time to time. We will post the updated Terms on the Platform with a new "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms, except where applicable law requires additional notice or consent.

11. Health information and security

SmileMatch implements security practices intended to protect account and platform data. Formal regulatory compliance obligations (for example, where a business associate agreement is required) are a pre-launch requirement for production use with real patient data, as described in our product specification and privacy materials. Do not label the service as meeting specific regulatory frameworks without appropriate contracts and legal review.
